PLAN COMMISSION

November 4, 2004

 

Members present:  Breault, Koch, Yoerg, Mailloux, Gilbert, Caruso and Bieraugel

 

Others present:  Jim Hill, Jerry Clark, David Linner, and others.

 

The meeting was called to order by Chairman Breault at 7:00 p.m.

 

Moved by Yoerg, seconded by Mailloux to approve the meeting minutes of 10/21/04. 

Motion carried.

 

Final development plans, 4,570 sq. ft. office building, 2401 Monetary Blvd., proposed lot 5, Hanley Office Park (south of Hanley Rd. and east of Foxglove Way) - James Fletcher.  Darnold noted that action on this plan was postponed at the last meeting so the developer could prepare a more detailed landscape plan for the frontage of Hanley Rd. including lots 5 - 7.  Mailloux asked what kind of trees would be proposed along the frontage.  Darnold stated two types - green ash and red sunset maple.

 

Mailloux questioned how the screening of the garbage facilities will be provided.  Darnold noted that the plans do not identify a proposed trash receptacle location, but that usually the developers have been very cooperative in providing a screen that is constructed of similar or complementary materials to that used in the principal building.  Darnold suggested that he could work with the developer regarding screening of any proposed trash receptacle(s) prior to Council consideration.

 

Moved by Mailloux, seconded by Caruso to recommend approval of the final development plans for the 4,570 sq. ft. office building at 2401 Monetary Blvd., proposed lot 5, Hanley Office Park with the following conditions:

            - The developer provide a letter of credit of $6,600 to assure demolition and restoration of public street, curb and gutter and boulevard improvements and city inspections within Monetary Blvd. right-of-way for driveway access and stormwater connection.

            - The developer to submit plans for screening of outdoor trash receptacle prior to Common Council consideration.

Motion carried.

 

Concept development plans, 24,920 sq. ft. auto collision center / auto repair, 3011 Harvey St., lot 29, St. Croix Business Park First Addition - River City Collision Center - Haase Investments.  Jerry Clark reviewed the proposed project noting the primary access and building orientation will be toward Rock St.  David Linner, project architect reviewed the building materials, colors and fence materials.  Breault commented that he has a concern of the amount of wall signage that is proposed for the building.  Darnold commented on required landscaping along the street frontages.  Breault noted that the developer will need to be careful not to obscure traffic visibility near the Rock St. / Hanley Rd. intersection.

Bieraugel suggested that the developer may want the stormwater ponding area to be more visible, and consideration should be given to plantings on the south side of the stormwater pond versus the Hanley Rd. street frontage.  Darnold commented that there were several comments from the fire inspector and city engineer that need to be incorporated into the final plans.

 

Breault commented that he would like to see the signage on the buildings reduced to be more complementary to the signage seen throughout the business park.

 

Moved by Yoerg, seconded by Caruso to recommend approval of the concept development plans for the auto collision center as proposed by Rivercity Collision  Center / Haase Investments with the final plans to incorporate the recommendations of the fire inspector and city engineer and the developer to review modifications to the signage to decrease the amount of signage on the building.  Motion carried.

 

Certified survey map (CSM), four residential lots, Section 22, Town of Hudson, east of STH 12 and north of Badlands Rd., (extraterritorial subdivision review) - Mike Germain, Grand Properties, LLC.  Darnold noted that this minor subdivision is located within an 18 lot subdivision, Hudson Estates, recently approved by the city in the extraterritorial subdivision review area bringing the total number of lots to 21.  The subdivision is located in an area designated as rural residential and not proposed for municipal sanitary sewer and water system extensions.

 

Moved by Mailloux, seconded by Koch to approve and recommend approval to the Common Council of the four lot certified survey map as proposed by Mike Germain, Grand Properties, LLC located in Section 22, Town of Hudson.  Motion carried.

 

Certified survey map, separating one outlot into two lots, Townhomes of Bieneman Farm - Bieneman Farm, LLC.  Darnold explained that Bieneman Farm, LLC is proposing the subdivision to divide the existing outlot 7 into two lots.  Each proposed lot will serve as the common space for the two different townhome associations, one on the north side of Trillium Way and one on the south side.  No new utilities are necessary, and no additional development would be created by the subdivision.  Darnold recommended approval.  Moved by Caruso, seconded by Mailloux to approve the two lot certified survey map as proposed by Bieneman Farm, LLC to create two lots from the existing outlot 7, Townhomes of Bieneman Farm.  Motion carried.

Revisions to the floodplain zoning ordinance, Chapter 253 - Community Development Director.  Darnold commented that the Wisconsin Department of Natural Resources (WisDNR) and the Federal Emergency Management Agency (FEMA) are requiring communities to update their floodplain zoning regulations to remain in compliance with the minimum standards of NR116, Wisconsin Floodplain Management state administrative rules and standards of the National Flood Insurance Program.  Darnold noted that WisDNR has provided a model ordinance to assist communities to update their ordinances.  Darnold commented that the draft that is presented is a proposed revision based on the model ordinance.  Darnold opined that it will be much easier to modify the proposed model ordinance to the city ordinance format than attempting to revise each section of the existing ordinance with the recommendations provided in the model ordinance.  This adoption consideration will require the city to rescind the existing ordinance and readopt a new ordinance based on the contents proposed in the model ordinance.

 

Darnold noted that the substantive changes that are required by WisDNR and FEMA are referenced by subject and page number on page iii to assist the plan commission, Council and staff to identify the areas of change.  Darnold also explained that the verbage used in the model ordinance is different in the other sections, but very similar to the existing ordinance now in effect; that ordinance was also based on a previous Wis DNR model ordinance.

 

Darnold commented that he is not requesting the plan commission to recommend approval of the draft ordinance tonight, but to request the Common Council to set up a public hearing to be scheduled for December 20th.  Darnold noted it is his objective to have the ordinance adopted and in effect by early February, 2005.

 

Bieraugel asked Darold to prepare a map showing what properties are affected by the floodplain ordinance.  Darnold stated he would prepare a map as requested.

 

Moved by Mailloux, seconded by Yoerg to postpone consideration of the floodplain ordinance until the December plan commission meeting and to request the Common Council to set a public hearing for the review of the proposed floodplain regulations for December 20, 2004.  Motion carried.

 

Revisions to NR118, Lower St. Croix National Scenic Riverway Standards and preparation of local ordinance - Community Development Director.  Darnold noted that the revised regulations for NR118, Lower St. Croix National Scenic Riverway Standards state administrative rules are now published, and copies of the new and former regulations are provided to each member.  Darnold commented that he is working on converting the revised regulations to a local ordinance versus adopting the state administrative rules, but the draft is not ready for review.  The administrative rules

stipulate that local rules must be adopted within 30 days of November 1, 2004, but the DNR realizes that adoption by the local community cannot happen within the 30 day requirement.  Darnold stated he sent a memo to WisDNR noting the city will begin review and consideration of the revised administrative rules in November with adoption scheduled for January or February, 2005.

 

Other business for discussion purposes or placement on future agendas.  Darnold  commented that he plans to schedule only one more evening meeting, December 9th, that that there are two development plans that have recently been submitted for review and recommendation to the Common Council and that an early morning meeting may be necessary to advance those plans in a timely fashion.  The plan commission agreed to try to meet for an early morning meeting, if members are available.
