The meeting was called to order at 6:31 p.m. by acting-Chairman Burchill.
A motion was made by Yoerg, seconded by Selissen to approve
the meeting minutes of August 6, 2009. Motion carried.
Certified survey map (CSM), two, zero-lot line lots, 1117 and 1121 Summer Street – Roger and Faye Schlemmer. Darnold reviewed the Schlemmer’s proposed two lot certified survey map creating two, zero-lot line lots in a R-2, Two-family Residential District. Darnold also noted that the applicants have provided a draft Common Wall agreement which incorporates the language addressing cross access to maintain and repair sanitary sewer and water services to the two residential units. Darnold recommended approval of the proposed two lot certified survey map as proposed by Roger and Faye Schlemmer, 1117 and 1121 Summer Street.
A motion was made by Selissen, seconded by Olson to approve
and recommend approval of the two lot certified survey map (CSM) as proposed by
Roger and Faye Schlemmer, 1117 and 1121 Summer Street with the condition that the
common wall agreement is executed and recorded at the St. Croix County Register
of Deeds and a copy of the recorded document be provided to the city of Hudson. Motion
carried.
Proposed modification of conditions placed on the certificate of compliance for the Little Minds Learning Center, 2400 Foxglove Way – Todd Barnhardt. Darnold explained that after the city of Hudson approved the certificate of compliance for the day care facility at 2400 Foxglove Way he received a call from the Wisconsin Department of Health and Family Services (WDHFS) in regard to conditions placed on the day care by the city of Hudson particularly the limits regarding the number of children and time of day that children could be outdoors in the designated play area. Darnold explained that he allowed those conditions to be temporarily suspended to address the WDHFS expressed concern that no other daycares in the city of Hudson had similar conditions placed on those businesses. Darnold noted that there have been no complaints received in regard to noise created by the children and that he is recommending that the city suspend the conditions of the number and time limits regarding children in the outdoor play area.
A motion was made by Yoerg, seconded by Olson to recommend that the Common Council approve an amendment to the certificate of compliance for the Little Minds Learning Center day care to remove the conditions that the outdoor play area can only be used between the hours of 10:00 a.m. and 4:00 p.m. and that the number of children allowed in the outdoor play area be limited to a maximum of 15 children. Motion carried.
Final development plans, 15 unit, Hudson Supportive Housing, 123 Heritage Boulevard, Heritage Greens planned residential development- Accessible Space, Inc. (ASI). Michael Knisely, project architect and Dan Billmark, ASI presented plans for the proposed 15 unit supportive housing project for

persons with disabilities. Billmark noted that the structure is a two-story building with all 15 dwelling units to be fully accessible for the convenience of the residents.
Darnold noted that there are still some site improvement issues that need to be addressed, but that following conversations with the city engineer that he was assured that the issues are being addressed.
Yoerg inquired about the issue of maintenance of the proposed underground stormwater system. Darnold explained that this type of system is more commonly associated with high density developments and that the city engineer wants to be sure that the issue of continued maintenance is being addressed. Billmark noted that the city is requiring a pre-treatment cell that will filter part of the sediment going to the system. The system will need to be pumped out on a scheduled basis similar to private septic systems.
Burchill thanked ASI for the opportunity to provide housing for persons with handicaps.
Motion by Yoerg, seconded by Selissen to recommend approval
of the final development plans for the 15 unit Hudson Supportive Housing
project at 123 Heritage Boulevard as proposed by Accessible Space Inc. (ASI)
with the condition that the final development plans be revised to incorporate
the comments and recommendation of the city engineer and fire department. Motion
carried.
Final development plans, 32 unit, Hudson Elder (age 62+) Housing, 100 Heirloom, Heritage Greens planned residential development – Accessible Space, Inc. (ASI). Michael Knisely and Dan Billmark reviewed the plans for the 32 unit elderly housing project. Yoerg inquired about the height of the building as part is as high as 46 feet. Darnold explained that the city in approval of the amendment to the conditional use permit approved a height limit based on the number of stories versus a specified elevation above the ground. Darnold expressed some concern on the number of issues that were identified in the review letter from the city engineer, dated 9-9-09, but that the city engineer has been working with the project engineer the past two days to address those issues. Based on conversations with the city engineer as of today, 9-10-09, he feels that many of the issues have been resolved. Darnold recommended approval of the final development plans with the condition that the plans be amended to address the recommendations of the city engineer and fire department and that no building permit or permit to start site work be issued until the city engineer receives and approves the amended plans.
Darnold reported that the street and utility work is proceeding on Heirloom and is scheduled to be completed, including final pavement by the end of September.
A motion was made by Yoerg, seconded by Burchill to approve
the final development plans for the 32 unit Hudson Elder Housing project, 100
Heirloom with the condition that plans be amended per the recommendations of
the city engineer and fire department and that no building permit or permit to
start site work be issued until the city engineer receives and approves the
amended plans. Motion carried.

Comprehensive plan update, implementation and extraterritorial areas. Darnold explained that Mike Darrow, SEH will not be able to attend tonight, but can meet with the plan commission next Thursday evening, September 17th. Darnold suggested that the plan commission postpone discussion of the comprehensive plan agenda items until next week to allow Mike Darrow to participate in the conversations. Darnold also proposed the plan commission wait to hold the open house until October 8 and set the public hearing date for November 12. The plan commission agreed to that schedule of upcoming meetings in regard to the comprehensive plan update:
- September 17 to discuss the implementation and extraterritorial issues
- October 8, open house, 4:30 p.m. to 6:00 p.m. and plan commission meeting at 6:30 p.m.
- November 12, public hearing, 7:00 p.m.
